About these terms

These terms apply to driving lessons, test preparation, lesson packages, defensive driving courses, assessments and other training supplied by Ben Davis Driving School in Hamilton, New Zealand. By making a booking or purchasing a package or course, you agree to the terms that apply to that service.

Important service-specific information shown during booking — including the service, price, duration, instructor, date, package contents or any special conditions — forms part of your booking.

Bookings and availability

• Bookings are subject to instructor and vehicle availability.
• Please provide accurate contact details and pickup/drop-off information when requested.
• Pickup and drop-off may be at home, school, work or another agreed location. A lesson can start and finish at different locations when arranged in advance.
• We may need to change the instructor, vehicle or booking time because of illness, staffing, safety, vehicle availability or other circumstances. If this happens, we will make reasonable efforts to contact you and arrange a suitable alternative.
• Booking a lesson does not guarantee a pass in an official licence test. Test outcomes are determined by the relevant testing authority.

Lesson packages

• A package contains the number and type of lessons shown at the time of purchase.
• Package discounts and prices are those displayed in the booking system when you purchase.
• Unused package lessons can be scheduled subject to instructor availability and any package conditions displayed at purchase.
• Purchasing a package does not reserve a specific instructor or recurring time unless this has been separately agreed.
• Pickup and drop-off details may be requested for each individual lesson because these can change between appointments.

Changes, cancellations and missed lessons

If we need to cancel or move a lesson, we will offer a replacement time or another appropriate remedy. Nothing in this policy limits any rights you have under New Zealand consumer law.

Safety and learner responsibilities

• Learners must hold the appropriate current driver licence and comply with all licence conditions while driving.
• Please bring and use any corrective lenses or other items required as a condition of your licence.
• You must follow reasonable safety instructions from the instructor.
• An instructor may refuse to start, or may stop, a lesson if they reasonably believe it would be unsafe to continue — including where a learner appears impaired by alcohol or drugs, behaves abusively, or creates a serious safety risk.
• If you are using your own vehicle, it must be roadworthy, legally compliant and suitable for the lesson.

Prices and payments

• Prices displayed in the booking system at the time of purchase are the current price for that booking or package.
• Payment methods available to you are shown during checkout or in the relevant course information.
• If a payment is reversed, declined or remains unpaid, we may pause future bookings until payment is resolved.
• Any refund or credit will be handled in accordance with these terms, the circumstances of the booking and your rights under New Zealand law.

Defensive driving courses and assessments

Courses, assessments and business/fleet training may have additional attendance, eligibility or payment requirements shown with the relevant course or confirmed directly with you. Where those specific requirements differ from these general terms, the service-specific information will apply.

Your rights under New Zealand law

Nothing in these terms is intended to exclude or limit rights that cannot legally be excluded. Services supplied to consumers in New Zealand are subject to the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 where those laws apply.

Website content and intellectual property

Website text, graphics, branding and other original content are owned by or used with permission by Ben Davis Driving School. You may use the website for personal information and booking purposes, but you may not reproduce or commercially reuse its content without permission.

Links to third-party websites or services are provided for convenience. We are not responsible for third-party content, availability or privacy practices.

Our Privacy Policy explains how personal information is collected and used when you enquire, book or use the website.
